included outsourcing

Outsourcing available with some models dedicated servers allows you to request the intervention of a technician on your server for:
- Installing or configuring applications,

Each intervention deducted at least 5 minutes of intervention on your monthly credit of minutes and the minutes are not carried over from one month to another. What are the domain transfer conditions?

For a domain to be transferred, it is necessary that it be tabled at another registrar. The domain must be in valid status, ie it must not be expired, or have protection against the transfer. 1. Physical hosting
The hosting of dedicated server is only on the premises of Redbus Interhouse located 130 Boulevard de Verdun - Courbevoie. The server is stored in a clean room, air conditioned in line with European standards. Access to the data center is monitored 24/24. The customer has access to the room through a dedicated server rental.

2. Internet Bandwidth
The server is connected to a 100Mbps network strand. The customer can have any time of the bandwidth subscribed in the offer selected.
Bandwidth is charged at the 95th percentile. This means that PHP will perform Africa, from the statistics of the use of the bandwidth of the identified customer every 5 minutes, calculating the "percentile".
The percentile is to rank in descending order the most important connecting peaks and remove the connecting peaks for 5% of the time. (So you get a free bandwidth burst for 5% of the time each month)
The next highest value is used to calculate the effective bandwidth consumption.
If the customer uses more bandwidth it has actually taken out in his contract, he will choose a suitable offer to his business or purchase additional traffic. If he does not wish to do so, he will lose the ability to BURST and will be clamped rigidly to the original flow.
The customer will be able to track at any time via consumption graphs of the outgoing and incoming traffic on its network allocated port.

3. Level 1 Support
PHP AFRIQUE offers the customer with a support level 1 this free 24h / 24 to the following services:
- Reboot hard
- Kernel Problem
- Problem when starting the machine
- Network configuration problem

4. Operating System
PHP AFRIQUE Booking preinstalled server (see below the list of installed software). We then provide the customer access "root" giving it a total administrative access to the machine.

ARTICLE 1: Contract Application
This contract is concluded between the hirer designated by the Customer and vendor designated by PHP AFRIQUE. This contract is applicable for any provision of leasing services and dedicated server hosting the client. The dedicated server is available to the customer by PHP AFRIQUE, who retains full ownership. The server physically hosted by PHP AFRIQUE which is also responsible to perform necessary hardware maintenance necessary for the proper functioning of the service.
Placing an order implies full and unreserved adherence of the Customer to these terms of sale. No particular condition can, except formal and written acceptance of PHP AFRIQUE, prevail over these terms and conditions. Anything to the contrary submitted by the Customer will, in the absence of express acceptance, unenforceable PHP AFRIQUE, regardless of when it may have been brought to the knowledge of the latter.


ARTICLE 2: Object of the contract
These general conditions are intended to define the technical and financial conditions under which PHP AFRIQUE agrees to rent and to host on its server platform, the Internet Dedicated Server Client.
Customer acknowledges that PHP AFRIQUE never involved in the design, development, implementation of the Customer's website and its computer tools for management and administration.


ARTICLE 3: Vehicles
The hosting platform and client server is accessible via stations connected to the Internet.
PHP AFRIQUE exclusively provides a server, internet connectivity, an IP address, a support level 1 and a maintenance service on site equipment.
The support Level 1 includes physical reboot of the machine (hard) and a possible intervention on the machine to boot (kernel).


ARTICLE 4: Technical assistance
PHP AFRIQUE provides Customer technical support by email and phone. This support is only concerned with questions and problems within the operation of the machine. The contact information for this support are available at http://www.phpafrique.com
Technical support is simply intended to provide ad hoc assistance to the customer. It does not aim to provide a response on the client machine. Any work on the machine, remotely, will be of specific benefit. For this, the customer should contact the sales department e-mail to previously establish an estimate of the intervention. Once the estimate accepted by the customer, and upon receipt of payment, the intervention begins.


ARTICLE 5: Billing Terms
PHP AFRIQUE conducts leasing and hosting of a dedicated server to the Client on its server platform upon receipt of the completed order form by the Client, accompanied by the corresponding payment and the contract signed by the Client. PHP AFRIQUE will acknowledge receipt of the Purchase Order, payment and contract, and inform the customer by email of the availability of dedicated server.
In the absence of sending the acknowledgment, the contract may be deemed not concluded. The effective launch of the dedicated server determines the initial date on which the billing takes effect. The contract is concluded for a period of one year.
For any exchange of information by electronic mail, the date and time of the PHP server Africa will prevail between the parties. This information will be retained by PHP AFRIQUE throughout the period of contractual relations, plus the limitation period for any action in Justice.


ARTICLE 6: Operating Conditions
The server will be hosted on the server platform PHP AFRIQUE. Upon request, the Customer has the possibility to order a change of hardware characteristics of the leased server. In this case, the rental rates and hosting server are changed depending on the change.
The Customer hereby acknowledges that fluctuations in bandwidth and the vagaries of the provider are elements that can cause discontinuity in the access server independent of the will of PHP AFRIQUE and its external technical resources. PHP AFRIQUE is committed to make every effort to ensure the permanence, continuity and quality of services it offers and endorses this as an obligation of means; accordingly, PHP AFRIQUE will endeavor to provide Internet access round the clock, 7 days 7.
PHP AFRIQUE offers various services for the installation of hardware or software for editing server configuration. These benefits are described on the site phpafrique.com, and the corresponding rates. Customer is the server administrator rented PHP AFRIQUE. It has root access to the server. The Client has the option to install itself of software applications on the server. ARTICLE 7: Responsibility PHP AFRIQUE
Responsibility for PHP AFRIQUE will not be engaged in the following cases:

- Improper use of terminals by the Customer or its customers
- Partial or total destruction of information transmitted or stored, to the directly or indirectly attributable to the client following errors.
PHP AFRIQUE can not be held responsible by the Customer of the non compliance, public order laws and obligations and good national or international customs.
PHP AFRIQUE undertakes to respect the protection of copyright of his client.
Due to the characteristics of the Internet, the customer fully aware of, PHP AFRIQUE can not be held liable for include:

PHP AFRIQUE can not be held responsible for the total or partial non-compliance with an obligation and / or failure of transmission system operators towards the Internet world and in particular of his or her providers.
Repairs due by PHP AFRIQUE in case of service failure resulting from a fault attributed to it will correspond to the direct, personal and some related to the failure in question, to the express exclusion of consequential damages.

ARTICLE 8: Liability of the Customer

The Client acts as an independent entity and therefore assumes only the risk of its activity. He alone is responsible for services and websites hosted on a dedicated server, the content of information transmitted, distributed or collected, their operation and their updates, and all files, including address files. The Customer agrees to respect the rights of third parties, including personality rights, rights of intellectual property of others such as copyright, patent or trademark. Therefore, PHP AFRIQUE can not be held liable for the content of information transmitted, distributed or collected, their operation and their updates, and all files, including mailing lists and at any capacity is.
PHP AFRIQUE can only warn the customer about the legal consequences arising from illicit activities on the site, and identify any joint liability on the use of the data made available to Internet users by the Client.

The Customer undertakes to take all necessary insurance with a reputable insurance agency to cover all damage that would be attributable in part of this contract or its execution.
The Customer warrants PHP AFRIQUE any action for third related to the content of information transmitted, distributed, reproduced, including those resulting from an infringement of personality to a property right related to a patent, a trademark, drawings and models, copyright, or those resulting from an act of unfair or abusive competition or a breach of public order, the ethical rules governing the Internet, morality, respect for privacy (image rights, privacy of correspondence ...) or the provisions of the Penal Code. As such, the Client will indemnify PHP AFRIQUE all costs, charges and expenses that it would incur thereby, including the reasonable fees and expenses of advice PHP AFRIQUE, even by a non-final judgment.
The Customer agrees to pay directly to the author of the complaint any sum that it would require PHP AFRIQUE. In addition, the Customer agrees to intervene at the request of PHP AFRIQUE to any proceedings against the latter and to ensure PHP AFRIQUE all sentences that are pronounced against him on this occasion. Use of SPAM is strictly prohibited. The customer agrees not to use the features of its messaging to send mass messages in large numbers (SPAM) or persons who do not wish to receive, some people may be placed on private files but do not desire to receive messages, PHP AFRIQUE will consider their opinions as well.
In case of non-compliance with this commitment, the customer recognizes that PHP AFRIQUE is entitled to limit, restrict, suspend or permanently suspend all or part of the service in question for a period of five days minimum or break definitively the contract in case of non-compliance warnings for spamming sent by the customer email.
The Customer undertakes to inform PHP AFRIQUE within 48 hours of any change in his situation, and within 24 hours of any loss of passwords.


ARTICLE 9: Contract Period
The contract is for a minimum specified under the description of the offer available on the website of PHP AFRIQUE which begins to run from the effective posting date of the Customer's Internet server.
The contract is automatically renewable for an identical period, according to the rates and conditions of PHP AFRIQUE into force on the date of its renewal unless terminated by either party in the conditions and time below.
In case of termination before the minimum commitment period, the customer will be liable for the remaining payments. It will therefore settle all amounts incumbent on this contract for the set time.
Either party may terminate automatically and without compensation, by registered letter with acknowledgment of receipt the contract in case of force majeure as provided in these terms and conditions.
It is recalled that each party may terminate the contract on the anniversary date of its coming into effect by registered letter with acknowledgment of receipt, subject to compliance with a notice of three months, in accordance with stipulations set .
In case of failure by a party to one or other of its obligations under the contract has not been remedied within 7 days from either a registered letter with acknowledgment of receipt sent by the complainant notifying the breaches in question or any other form of notification authentic addressed by such party, the contract will be automatically terminated, without prejudice to any possible damages that could be claimed from the defaulting party.
The date of notification of the letter containing the infringements in question will be the date of the postmark, at the first presentation of the letter.
If PHP AFRIQUE cancels the contract within the specified requirements, the Customer may not claim reimbursement by PHP AFRIQUE amounts already paid.
Upon termination of the lease and hosting of a dedicated server, PHP AFRIQUE agrees to delete all customer data installed on the dedicated server.


ARTICLE 10: Prices and invoicing
The current rates are available online at http://www.phpafrique.com site. All prices exclude taxes and are payable in CFA francs or Euros (1 Euro = 655.957 CFA).
Payment is made by monthly advance or annuity.
All duties and taxes applicable to these prices will be charged in addition to the date of legal force layout.
By express agreement, unless requested postponement in time and granted by PHP AFRIQUE specific and in writing, the total or partial non-payment when due of any amount due under the contract ipso jure and without prior notice and without prejudice to Article termination:
- The immediate payment of all sums due by the customer under the contract, regardless of the payment method provided.
- Billing the customer default interest equal to one and half times the legal interest rate, the last rate published at the date of invoice, interest is payable by the mere fact of the expiry of the contractual term. The interest is calculated pro rata over the period of one month.
- The customer will claim 20,000 FCFA for each unpaid VAT return found by PHP AFRIQUE rejected by the Bank.
Any dispute concerning the interpretation or execution of these General Sales Conditions will be the exclusive jurisdiction of the Commercial Court of Cotonou.
The general and special online prevail over the general and special conditions printed. The parties agree that PHP AFRIQUE can, by right, modify its service without other formality than to inform the Customer by a warning line and / or bear changes in the terms and conditions online. Any changes or introduction of new subscription options will be on-line information on the site located at the URL http://www.phpafrique.com or sending an e-mail to the Customer. In this event, the Customer may, notwithstanding Article TERMINATION general conditions, terminate the contract within thirty days from the entry into force of these amendments.


ARTICLE 11: General Provisions
The headings of the Articles of contractual conditions are intended only to facilitate reference and have not by themselves a contract value or special meaning.
All notices, communications, formal notices under the Terms will be deemed to have been validly delivered to the Client if sent by registered mail with return receipt to:

ARTICLE 12: Applicable Law
The hosting service agreement with an online information system is subject to French law.
Subject to Customer trader, any dispute concerning the interpretation or execution of this contract within the exclusive jurisdiction of the Commercial Court of Grenoble, including any summary proceedings notwithstanding appeal as collateral and / or multiple defendants.
